Term of sales
The purpose of these general conditions of sale is, on the one hand, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered, and on the other hand, to define the rights and obligations of the parties in connection with the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales, by the company Atan, of the products offered on its website.
Consequently, the fact for any person to order a product offered for sale on the Atan company’s website implies full acceptance of these general conditions of sale, of which the Buyer acknowledges having read prior to his order.
Atan reserves the right to modify these general conditions of sale at any time.

The sale prices of products online on the Atan website, www.atan.fr, are indicated in Euros and include VAT (with 20% VAT), and are those in force at the time of registration of the customer’s purchase order.
They do not include shipping costs, invoiced in addition to the price of the products purchased according to the amount of the order. Shipping costs will be indicated before the customer registers the order.
The selling prices of the products may be modified by Atan at any time. This change will be notified to the customer before any order.
4. Product Features
In accordance with article L 111-1 of the Consumer Code, the customer may, prior to placing an order, consult the website www.atan. fr of the essential characteristics of the product(s) he wishes to order.
The offers presented by Atan are valid within the limits of available stocks.
Any order implies acceptance without restriction or reservation of these general conditions of sale.

Payment must be made when ordering by the customer. At no time can the sums paid be considered as a deposit or down payment.
The collection of the entire amount of the order will be made by Atan at the time of validation of the order or in the event of payment by check upon receipt of it.
All orders are payable in euros.
To pay for his order, the customer has all the means of payment referred to in the order form: Bank card (Credit card, Visa or Mastercard), Cheque, Transfer or PayPal.
Atan reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the customer or in the event of an incident of payment.
Atan reserves the right to request a photocopy of the customer’s identity card for any payment by credit card.
As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.
7. Choice of products
The customer having read the products and their characteristics, marketed by Atan, has under his sole responsibility and according to his needs as he has previously determined them before any order, made his choice on the product or products making the object of his order. In addition, the customer, knowing only the products he owns and uses, is the sole judge of the compatibility of the products ordered with those used by him.

8. Delivery and receipt
8.1. General rules
The products will be delivered to the address indicated by the customer on the order form, in Europe, with the exception of Germany and the United Kingdom.
Indeed, Atan collaborates with exclusive importers in these countries and it is advisable to contact them for any order.
8.2. Time limit
Items purchased on www.atan.fr are sent within 8 days of receipt of the order, unless otherwise indicated to the customer. . As for products out of stock, Atan undertakes to report it on the site.
Once the order is ready, we deliver it to the following carrier: La Poste.
The average delivery times of carriers from the Atan depot are as follows:

These deadlines are provided for information only.
Any overrun may not give rise to damages, withholding or cancellation of the order by the customer.
In the event of late delivery in relation to the date initially fixed, the customer must report it in writing (e-mail, customer support) to firstname.lastname@example.org</ a> in order to improve the quality of service that may be offered to it and to allow Atan to carry out an investigation with the carrier which may last up to 21 working days. If during this period, the product is found, it will be immediately redirected to the place of delivery designated in the order form.

Before accepting delivery, the customer must check the condition of the package.
In the event of an anomaly, the customer must refuse the package and indicate on the delivery note the reasons for the refusal by listing the problems observed, otherwise no complaint will be possible.
The customer must limit himself to indicating the damage observed, avoiding the information that the delivery person may indicate to you, such as “undamaged packaging” or any other mention that may exclude their liability.
Any risk of loss or damage to the goods is transferred to the consumer when the latter or a third party designated by him takes physical possession of these goods.
9. Availability of products
In the event of partial availability of the articles, Atan will not make a split delivery. An exceptionally missing reference may be replaced by another reference in agreement with the customer or Atan will reimburse the missing item. In any case, Atan will inform the customer as soon as possible.
10. Quality or Compliance Issues
In the event of delivery of a product that does not correspond to the order (error in model, size, etc.), the complaint must be made by email in the contact section on our website www.atan.fr within 7 days of receipt of the product.
Any product to be exchanged or refunded must be returned to Atan new and in its original packaging. Failing this, Atan will not make any exchange or refund.
If the error comes from Atan, the return costs will be borne by Atan. If the error comes from the customer, the return costs will be borne by the customer.
The customer :
– has a period of two years from the delivery of the goods to act
– may choose between repairing or replacing the good, subject to the cost conditions provided for by article L. 211-9 of the consumer code
– Is exempted from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.
The legal guarantee of conformity applies independently of any commercial guarantee granted.
The customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and that in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.
11. Right of Withdrawal
The products must imperatively be returned to Atan in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.) accompanied by the purchase invoice. Any product that is incomplete, damaged, damaged or whose original packaging has been damaged, will not be refunded or exchanged.
In accordance with Articles L. 221-18 and following of the Consumer Code, the customer may exercise his right of withdrawal within fourteen (14) days of receipt of the product(s) ordered.
If the customer returns all the products in his order within fourteen (14) calendar days of receipt of the last product, all payments received by Atan for the purchase will be refunded to him, including shipping costs (to except for additional costs resulting from the customer’s choice of a shipping method different from the least expensive ordinary mode offered).
If the customer decides to keep a product and, therefore, to exercise his right of withdrawal on only part of his order, he will only be reimbursed for the price paid for the products but the shipping costs will not be reimbursed.
To exercise his right of withdrawal, the customer must inform Atan of his decision to withdraw by means of an unambiguous declaration expressing his desire to withdraw.

12. General refund conditions
Any refund will be made by any means of payment within 14 days of receipt in Atan’s warehouses of the package returned by the customer.
The warranty period is 24 months from the date of purchase upon presentation of proof of purchase.
Any product that is incomplete, damaged, damaged and/or whose original packaging has been damaged, will not be taken back or exchanged under the guarantee.
No returns will be accepted without prior authorization from Atan.
The costs of returning the product are the responsibility of the customer.
The product under warranty will be, at the choice of the manufacturer, exchanged or repaired.
Atan only guarantees the customer, against hidden defects that may affect the products delivered, within the framework of a replacement of the defective products, or of the parts rendering them unfit for their use, without being able to be considered by the customer as responsible for any harmful consequences that these latent defects could have caused.
In any case, the warranties do not cover:
– replacement of consumables.
– abnormal and non-compliant use of the products.
– damage subject to a specific mention in the article sheets.
– defects and their consequences due to the intervention of the customer or a repairer not approved by Atan.
– defects and their consequences related to use not in accordance with the use for which the product is intended (professional, collective use, etc.)
The products offered by Atan comply with the French legislation in force.
Atan cannot be held liable if the non-performance or poor performance of the contract is attributable either to the customer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure.
Atan cannot be held liable for any consequential damages that may arise from the purchase of the products.
The total or partial impossibility of using the products, due in particular to an incompatibility of equipment cannot engage the responsibility of Atan nor give rise to any compensation or reimbursement.
15. Partial invalidity
If one or more stipulations of these general conditions of sale are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations shall retain all their strength and scope.
16. No Waiver
The fact for one of the parties not to take advantage of a breach with the other party of any of the obligations referred to in these general conditions of sale cannot be interpreted for the future as a waiver to the obligation in question.
17. Applicable law
Sales of Atan products are subject to French law.
18. Computing and Freedoms
The information collected by Atan during any order from the Buyer is necessary for the management of his order by Atan and its business partners. In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the Buyer has a right of access, rectification, opposition and deletion of data concerning him with Atan.
